    Lawsuits After Bankruptcy

    My wife got us into a pickle with some business lawsuits and some debt due to the economy. I understand the lawsuits will be discharged, but what happens during and after bankruptcy if we are hit with another frivilous lawsuit???

    Can you wait to file until the mess clears up a bit?

    If she has debt with some creditors, just be sure to list them all, that way even if they try to sue they will be stayed by the BK filing.

    What kind of lawsuiits are they?

      Once you've filed bankruptcy and been discharged then they can't sue you to collect any discharged debt, doing so would be a violation of the bankruptcy court's order.
      May 31st, 2007: Petition Filed by my lawyer
      July 2nd, 2007: 341 Meeting Held
      September 4th, 2007: Discharged and Closed.

        Really depends on what the lawsuits are.

        I had something similiar, where someone was threatening to sue. Lawyer laughted and included what they asked for in the BK. Said it does not matter now if right or wrong, it will be discharged.

          Rick is correct. List anyone who could conceiveably have a claim. Does not matter if they intend to sue or not.
