    Now my wait starts. Anyone in Southern California?

    I just talked to my attorney. He's not dancing yet although the USTT signed off which indicates that we are in a 7 not a 13.

    We are waiting for the TT to decide.

    He IS sending me a bill as if it were closed which at least tells me he is optimistic.

    He is unclear about the timing of the discharge though. It could be 60 days from the first 341 which means it could come any day or 60 days from the LAST 341 which was to be today.

    He does not want to call the TT and I agree because he does not want to create a sense of urgency and have them start with any other BS items to look into.

    He said that it could happen in two weeks or four months. Little consolation he knows but he can't guarantee anything.

    Last day for objection by the TT is June 11th.

    Anyone with experience in So Cal as far as knowing how backed up they are?

    I can apply to modify my loan after the no asset report is issued. I assume that is the discharge.

    Four months is a LONG time.

    Any thoughts?

    I'm not sure I can be much help in your situation but a no asset report is NOT your discharge. That will clearly be spelled out when it happens. It will show up on Pacer first and/or your attorney will let you know. We recieved our discharge on the same as as the last day for creditor objections. It did take over four months to have the case actually closed. We are in San Diego county.
    Filed Ch 7 - 6/30/08
    341 Meeting - 7/31/08
    Discharged - 9/30/08
    Closed (finally) - 2/10/09

      Thanks, you actually have helped to clarify matters.

      What I need is a no asset report in order to start the negotiations with the bank.

      When did you notice the no asset report and does it actually show up on Pacer?

        Your No asset report will show up as "Trustees report of no distribution"

        It will say something like, "The trustee reports that there are no assets to distribute in this case and prays to be relieved of his duties" or similar verbage.

        Good Luck.

        I believe your discharge date is 60 days from the first 341, unless the TT has asked for an extension for creditor objections.

          Perfect. Any idea when this appears?

          The last date for an objection by the Tt is June 11th. the last day for creditors passed months ago.

            6 Jul 09: 341 Meeting, declared asset case, 341 continued
            6 Aug 09: Continued 341 meeting, came to settlement with TT
            6 Sept 09: Last Date for Creditor Objections

              I just finished with my extended 341's and had my last day for objections on Friday (filed in San Diego, now live in Los Angeles) Your last day for objections is from your original 341 UNLESS the UST motions for an extension. Most likely this won't happen since you still have until June 11th for the original objection period. Mine was extended because my first 341 meeting was rescheduled 4 months after the original date.

              Keep checking PACER and check the "deadline/schedule" section, at the very bottom is your due date for your last day for objections.

              Fingers are crossed for you!
              12/05/08 - filed pro se
              01/27/09 - case dismissed and closed - 02/24/09 - case reopened and dismissal vacated
              04/01/09 - new 341 scheduled
              6/02/09 - DISCHARGED!!!

                What would I do without this forum??????

                I nearly became addicted to PACER and went four days without checking.

                Now I will become obsessed once again.

                  I have kicked the PACER habit for like a month now, (Discharge is like the Narcon of PACER).

                  Still get the urge......just ...gottta.......fight......it!
