    Three's a charm........

    Had a third consultation with an attorney on Friday and retained him for our BK. The first attorney was terrible, the second was good, the third is excellent! He went over all of our information and said we definately are a chapter 7, but also explained the 13 option and the differences according to our situation. We are behind on our 2nd mtg. and thought because of that we would have to do a 13. He said we can do a 7, then later address the 2nd either by doing a chapter 13 just for the 2nd and a lien strip, or a settlement with the 2nd mortgage holder for 10 cents on the dollar. He did the figures and it would be less expensive to do a 13 on the 2nd later or a settlement than if we did a 13 now and what we would end up paying for it. We were so happy to hear we could do the 7 now and deal with the 2nd later. He told us the trustee for our area is very good to work with, and understands how the economy especially in our county has impacted people's financial difficulties. He basically said he does not give people filing BK a hard time or anything like that. I was relieved to hear that also. Yesterday opened up our phone line and got some CA calls and gave them our attorney's name and number. That felt so good to do that, knowing we are moving forward in the right direction for us. He said BK is not like it was years ago, he said now you can get credit for new car and even a mortgage for a home shortly after a BK now, also confirmed that after BK you will start to receive cc offers in the mail. He also gave us a program included in the BK fee for achieving financial freedom after BK. It contains really good information on how not to get into a bad debt situation again and other good strategies to get in good financial standing again. We are so happy, the relief we feel is unbelievable.

    Yes, it is very important to have an attorney that knows what s/he is doing! Sounds like you have a good one...

      Glad you found the lawyer for you , it is very important to shop around until you find the right fit. Good luck with everything
