My wife and I will be filing a Chapter 13 Bankruptcy the beginning of October this year. We need to replace a car in which the lease expires next year. Obviously, we'll need to do this prior to BK.
In prior purchases, we've had great luck with Capital One Auto Finance, however, we also have a $14,000 credit card balance with them that will be discharged in the BK (they'll get nothing in the plan).
If we get financed through them, is it possible that they will repo the car in a chapter 13 due to cross-collateralization, even if though the payments will be current and never late?
