    Question Filing Chapter 7 in Alabama complicated why

    Hi all just wanted to get some feedback on some people that has filed in Alabama.

    I actually filed in Illinois 6 months ago and it took 1 trip to the laywer and in 20 minutes the lawyer had me filed online with 1 signature.

    My brother and I just moved to Alabama 4 months ago and he wants to file for chapter 7 so I called around for him and no one can do it online at the lawyers office? You must come in pick up 50 pages to fill out then bring them back then in about 1 month they will call you to come back in to sign the papers after the lawyer files it. Then have to go to the creditors meeting after that.
    Why is it sooo complicated in Alabama. He just started working and he has to take off at least 3 different times to get this done.

    Anyone in Alabama have this same issues? Because I did call around and it seems like everyone down here is doing it the same way.

    What the attorneys in Alabama are proposing is the norm. A 20 minute trip to the lawyer and an immediate online filing is very rare.

      Wow, I did not know that was rare to have the lawyer do that online while you are there. I was thinking is was wierd not to be able to do it online.

        OP, did you attend your 341 meeting in Illinois?

          Hi,
          Yes mine was all done in Nothern Illinois.

          The receptionist asked me on the phone if I used any credit cards in the last 3 months (and I did ) so I had to wait until the 3 months was over not using the CC'S. Then I called back after the 3 months and she told me everything to bring in, 6 months pay stubs, 4 years taxes, all the bills, etc.. Then I went to the office and the Attorney looked at my paperwork and went on his computer and started asking questions like how much I have in my checking acct, savings, etc, how much personal belongings do i have like bed,clothes, tv etc, he just asked me all the basic questions that was needed to get it filed and then asked for the money then he had me sign 1 paper and said you are filed and this is your case # and the 341 was on this date it was about 1 month from the filing date. All that took between 20-30 minutes. Besides the convenience that it was I would not recommend the laywer I had because He would not return any questions I had after the filing and before it was discharged. Everything went smooooothly but I did have a few questions that was bothering me like if they were going to take my $2500 tax return and a couple of small questions that I wanted to know about but he would never call back.

          It would not of bothered me as much to go a few times back to the office because I was not working at the time but my brother just started working and needs to take off 3 times to get it finished.

            I hate to say this, but everything is bassackwards in Alabama. I moved here three years ago and stilll find myself shaking my head a couple of times a week.

                What still confuses me about the filing is that Bankruptcy is really done by the government even though each state has different laws for different things.

                If one state can do the filing instant online while the client waits why can't other states do the same thing. It would be the same server they are accessing just different areas on thw server for different states. Yes it is a benifit to the client but also the lawyer because they don't have to play the game on making several appointments with the same client.

                Isn't that is why computers were made to make thing easier??????

                  Ha! The same reason you go to 4 different offices to get a car tag, rather than one office, or, perish the thought, - online!! Or why locals cant pass laws regulating garbage pick up without putting it on a state wide ballot. Alabama is extremely creditor friendly, and debtor unfriendly (too mild a word).
