    First Lawyer Visit, Trustee & fees

    I had my first face to face with a BK lawyer yesterday.

    - Laywer commented on our District Trustee as requiring all debt, everything go into the plan - the higher the value of he BK the more money for her and he commented that last year she made over $350,000.

    - Lawyer said that this trustee does not go for anything frivolous in the living expense plan including $$ for gifts, entertainment, 401K contributions

    - He said his fee included one amendment during the life of the plan and that more than one amendment or change to the plan over the course of 5 years would result in additional fees. Is there an average number of amendments to a BK13? one, two, none? I imagine most reasons would be unexpected so how could you plan? I will ask subsequent lawyers how they handle possible amendment costs.

    ?? Is there any relationship between the success of the plan and the laywers experience or business relationship with the Trustee?

    Should I worry about selecting a lawyer that the trustee hates and will it impact my plan and approval to do this BK13? How would questions to potential attorney's be viewed if I asked them about the Trustee and their experiences?

    I searched our District Trustee's name on Google, no mySpace or Facebook pages !

        Trustees are limited to earning $177,000 per year as trustees. They may do other sorts of work and make more money, but that's the limit. Go to the US Trustees website and you can verify this.
