    MSN Ask a Credit Counselor is doing more harm than good

    I find it very frustrating when people ask for help and are told that they have no constitutional right to do so with regards to bankruptcy. A poster on the MSN board has repeatedly posted that people do not the constitutional right to seek bankruptcy protection. Is it possible that creditors would post such in order to dissuade people from filing? Are they trying to keep the uninformed..uninformed?

    Yes it is possible and likely....

    From Article I Section 8 of the US Constition:

    To establish an uniform Rule of Naturalization, and uniform Laws on the subject of Bankruptcies throughout the United States;



    So there is a constitutional right
    May 31st, 2007: Petition Filed by my lawyer
    July 2nd, 2007: 341 Meeting Held
    September 4th, 2007: Discharged and Closed.

      Absolutely. Before filing, I told some collections callers that they were wasting their time because I was preparing to file for ch. 7. They then tried to give me all kinds of false information about bankruptcy, basically telling me that I could not file for it, even if I did it would be dismissed, and I was better off dealing with them. When I pointed out the inaccuracies in their info, I was bluntly told that they were the professionals, and they knew more about it than me.

      This was deliberate misinformation intended to intimidate me. It would not surprise me if agents of banks and collection agencies were trolling financial boards (maybe even this forum) dispensing false/misleading info.
      I think of my bankruptcy less as "walking away" and more as "gnawing my leg off to get out of a trap".

        OH YES this board is trolled. We see this all the time. This is why the mods kill off email addresses and personal info not wise to put up to Public view.

        I had one firm offer me a wonderful settlement on a Saturday only good till Sunday. The reason is, I could not ask my lawyer till Monday, and IF I had settled, it would have ruined my bk as in preferential payment. Bill collectors are one step below 'bottom feeders'. Perhaps they are the excrement of the bottom feeders. 'Hub

              What's funny, the poster in it's last post "That code gives people the right to file, or not file depending on whether they meet the criteria."

              But the poster still say's an individual has no right to bankruptcy. That seems like a double standard to me.
