    Trying to convert from a 13 to 11...need advice!

    Hello everyone, its been quite awhile since I been here and I have a huge dilemma and I'm hoping that I can get some guidance. I filed a ch. 13 about 7 months ago and have paid my monthly dues ever since...I heard from a friend/colleague from higher up that my company is on the verge of BK and will be letting everyone go within the next 6-8 months. So I did what any normal person would do and that is to look for another job. After careful consideration, I decided to resign from my position because I had a great oppurtunity in the same field. It just so happens that after I resigned...I went to the other employer and they informed me that they were no longer interested in hiring me!!! I know I know...I shouldnt have trusted them and waited to see if everything went through but I was dumb and stupid and now I'm living with the mistake daily. I tried to get my other job back and they basically gave me the finger!

    So now I have unemplyed for a little over a month trying to find a job. I havent been able to pay the BK monthly fee...I had to borrow money from just about everyone I know just to get by paying the important bills. My question is how does a convert work and my biggest concern is about my tax return check...I was expecting $11,000 from federal and I was hoping for this to be my life line until I can find a decent job. If my 13 case gets dismissed will I receive that tax return?

    Normally, you wouldn't convert to a chapter 11. A chapter 11 is a reorgranization for corporations and high networth individuals. I think you mean that you want to convert to a chapter 7.

    Without more background, we can't really say. But as for the mechanics of it, you would simply file a motion to convert. If you have a lawyer, you should be in touch with him ASAP to discuss your options.

      omg...im sorry but i did mean a chapter 7...thanks for correcting me

      i have a meeting with my lawyer on friday but just wanted to know what to expect if anyone knew
