    I just want to cry

    I am really stressed this afternoon. The large task in front of my is making me nuts.

    I haven't been thrilled with my attorneys so far but may have to go back to the second one just so I can get the ball rolling.

    My BF doesn't think it should take me this long to get this put together, 3 months. I said you have no idea of all that I have had to do because of the business part of this. I would have had to wait anyway because of credit advances in Jan. It is 90 days now.

    He said he will just put the company in his name and I said we can't do that either because we will end up getting the case dismissed.

    He said the trustee is not getting any of the money we have coming in so I have to get going or else I am going to be waiting a long time.

    I just need a cyber hug...

    I am sorry, it gets better. The waiting and anticipation suck, but it does get better.

    Take a walk and just breathe and forget about it for the afternoon.

    Or drink some wine and then go for a walk, it will make the walk more fun!

      jb300, OMIGOD, I totally feel your pain. I swear I had several little "dramas" when I was doing that damn paperwork - and mine is a no asset case with hardly nothing on the paperwork. Easy peasy compared to yours but still major pain. That printing stuff alone made me want to tear my hair out. I broke down crying a few times because of the stress. My advice: Stock up on printer ink.

      Honestly that was the hardest part of this so far but my journey isn't over yet by a long shot. Take a personal day after you complete the paperwork - you wil deserve. I only had a weekend to do mine (well, that was the way I scheduled my appointments but I was glad to just finish the damn thing anyhow)

      Don't worry you will get it done, just take it one step at a time and go at it!

        stick in there! once you get the ball rollin', it does get easier... the stress may linger, but think about what you are doing and what a relief it will be when it's all over... look towards the light at the end of the tunnel; it helps.

        my wife and i just went through with 341 and it was much more painless than the stress that accompanied it. do it right and you will be good to go...

        besides, all the stress doesn't help you, so find people who know, who can help, who can speak with, who motivate and encourage and move on...

          It does get better. I was so focused on keeping my good credit (790 score)that bankruptcy didn't even dawn on me until a few months after I wiped out my savings and took all I could from my 401K and spent every dime I had to pay bills, I was stressed out and it showed on my faced.

          I found this forum and spoke to several bk attorneys. Once I reviewed my options and faced the reality of my situation, I felt relieved. I don't think that people plan for their situations to turn out like this. Life Happens. And life bit me in the behind! So here I am.

            Thanks everyone... I just have been buried. First I had to get some taxes for him done. Then get my own taxes ready to go. As well as getting documents ready for the attorney.

            He thinks you can just throw together a few things and you are good to go. I had over 1K in cash advances from a credit line in Jan. of this year for my checking account. I had to have those 90 days.

            How long did many of you take to get it ready to go?

              Hubby and I met with the Attorney last Sept. and quit paying most of our CC's except one which I had a large balance transfer in Aug. & he told me to pay more than the minimum for 3 mths, but to quit paying the others.

              We won't be filing until 9/30/09 as I had a monthly draw from a QDRO (divorce) coming in each month until Feb. 09 & attorney didn't catch that it would be taxable (found out on this forum) & we would be over the limit.

              Don't be rushed or pushed to complete those Multiple, multiple pages to give to the Attorney, Tell your bf to 'get a grip'. I spent almost 4 1/2 months just trying to fill out the Asset part as I inherited some 'old' furniture & jewelry.

              I have several spreadsheets I update each month as our Attorney told us to use ou past 12 mths (9/08-8/09) for the budget. I received SSD as I am 100% disabled which is not counted in the means test but the gross is counted for the budget part.

              I've read some of your posts and know you own a business. I feel for you because I know that makes for lots of extra 'thinking' & paperwork. I haven't commented on those posts because I don't know the answers. I would think though you would had filed your taxes on a Cash Basis & not an Accrual Basis.
              In other words, you haven't claimed the income nor the expense side on your income taxes until the job was completed. That's just my personal opinion.

              Don't let that paperwork get your down. It so easy to slip into Depression and so Hard to get out of it. Trust me, I've been down that road.

              I'm so glad we didn't file in Dec. 08 when our Attorney wanted us to, because since then, I've had female surgery,skin cancer surgery and hubby was in the hospital for a week & off work for a month. Even tho, we have medical insurance our prescriptions or over $500 a month & hubby's insurance has a $500 deductible and a $2,000 out of pocket expense. If we would have filed, we wouldn't be able to pay that as I'm sure the Trustee would have taken our tax refund, which we will use to pay for our surgeries.

              So to me, that's a 'Silver Lining' in our pocket. Both of us think the 'Big Guy" (our God) has been looking out for us!!

              Once you get the paperwork sorted out, I've heard it's smooth sailing after that. So, will be praying you can 'hold up' until you get to that point.

              PS The phone calls were hectic at first. I think I've talked to All of our creditors twice & since then have received only 3 not so nice letters. Attorney said not to worry. If I get something I need to sign for or someone comes to the house, he will file something in Court to stall them until we get filed.

                Well the attorney emailed me back about 30 minutes ago and I go back into see him on Friday of this week. I had already spent about 40 minutes with him the other day. He needed to check on the status of the house I bought on contract. He got the answer he wanted on that so despite the fact I wasn't thrilled with his personality I am going to give this another go.

                This time I am taking my BF with me. I will take tomorrow and get April updated and then I am ready or I think I am. I am just tired and need this to get underway and deal with what comes as it comes.

                I guess one step, one day at a time.

                I guess if they penalize me for making a mistake then I will have to deal with it but I just don't know what else to say to them.

                  I'm on my 2nd attorney as well and almost wish I had stuck with the first attorney because this would be almost over by now. But he did not put me at ease and even though I feel they need to be truthful with their clients, I don't think they should be making you more nervous. He was also impossible to get ahold of. He worked out of his home and had no office staff. When I did catch him, he'd be on his carphone and cranky. I refuse to deal with disrespect when I'm the customer.

                      Here it is 2 am and I am up because I can't sleep. I slept a few hours on the couch earlier and now I woke up and I am thinking why did I make that appt. with that guy again on Friday.

                      This is the one that told me I would lose my 1995 camper that the roof and plumbing leak, no refridg because it broke the furnace is broke, dry rotting walls, hail damage, needs new tires, holding tanks wired up, and he says it is a luxury item.

                      I think I need to slow down catch my breath and talk to #3 again tomorrow before I keep that appt. on Friday with #2. I almost have #3's paperwork done and if I miss my window of opportunity to file next week, there will be another one but it could be a month or so before I can do it again.

                      Back to the paperwork for an hour or so and then hopefully my headache will be gone so I can sleep again.

                        Like I said in my post to you, don't Rush on the paperwork if you can wait a week or even a month. All of your Assets should have the same figure, except Cash on Hand and Bank Acct.

                        If you pay some bills before filing, just add them to your list and divide by 12 if you are using a whole year's worth of expenses or divide by 6.

                        I'd keep the appt. with the #2 Attorney. Shoot, maybe copy the papers you received and have filled out from #3 Attorney. Just make sure you white out his information.

                        If you still have questions, that haven't been answered, maybe #2 can answer those. I wouldn't pass up another Free Consultation if I were in your shoes.

                        Yes, I'm awake also. I tried to sleep, but with hubby being off a month (one week in hospital) I haven't started on March or April expense spreadsheet. I've got receipts everywhere LOL!

                        With hubby being a Truck Driver, I'm able to sneak in a 1 1/2 hr - 2 hr nap during the day if need be.

                        Have you tried any of the OTC sleep aids? I'm on a prescription for Ambien, but as you tell, it doesn't work when your brain is running very fast LOL!
                        My MIL swears by Alleve sleep aid, but she says it is expensive. Before my husband saw his doctor after getting out of the hospital, he took Wal-Mart's brand - Equate PM pills. He said they worked. But now he is like me and takes Ambien.

                        Hang in there. Make sure you haven't left off any expenses like things you pay annually every year.

                          This is what #2 said. I will talk to #3 tomorrow and if he can't get me in on Friday I will consider #2 but I just don't know. BF is coming with me when I go to whoever again. He needs to hear this stuff.

                            JB300, don't pressure yourself to use an attorney that you are not comfortable using.

                            Of course, it is the attorney's job to tell us the way it is - not what we want to hear. But we see attorney's all over this board providing wrong information to their prospective clients.

                            It is more important when you have a small business to have the right attorney. It makes the difference between a successful, smooth BK and one filled with errors. If you have a gut feeling about an attorney - listen to your gut.

                            As to the BF's comments about doing transfers - hopefully he is expressing his frustration with the process and not serious. It is important that he understands that the business must be handled right so you do not lose the business or the income. The business transition must be appropriately planned with your attorney so you benefit the most and not the Trustee.

                              He is completely serious. I mean totally.

                              I called attorney #3 this morning and I am able to get into him at 8 in the morning. So I am going and will probably have an emergency come up that I can't make it to the 1:30 with #2 that I didn't like and was the least comfortable with.

                              I feel better already just having talked to their office this morning and emails he has sent me. Keep your fingers crossed.
