    How to stop collectors from calling-for good!

    How many times a day do you receive a call from collectors at home or you're place of work? One,three, ten? Well you don't have to receive any if you what to do. Write the letter below send it certified mail, return receipt.
    It works!

    Dear Debt Collection agency:

    This will serve as your legal notice under provisions of Federal law, The Fair Debt Collection Practices Act (FDCPA), to cease all communications with me in regard to the debt referenced above.

    If you fail to heed this notice, I will file a formal complaint against you with the Federal Trade Commission who is responsible for enforcement, the States Attorney General office and/or the American Collectors Association or local State Bar Association.

    I/We have decided that we do not desire to work with a collection agency under any circumstances. I/We will contact the original creditor to resolve this matter directly, as circumstances warrant.

    You are also notified that should any adverse information be placed against my/our credit reports as a result of this notice that appropriate actions will be taken.

    Give this very important matter the attention it deserves.

    have you used this, and how well did it work? The harrassing calls from CA's are my biggest fear when I stop paying my credit cards here real soon.

      Might work for collections agencies...original creditors will laugh and keep calling 10 times a day.
      Unless it's been more than 3 months since you fell behind, it's probably the original creditor calling.

        I would avoid cease and desist letters to your original creditors..Many campanies now immediately forward your accounts to arbitration when they recieve C/D letters.

          Please provide a source for this statement, there is no evidence I have found to support this statement.

          C&D letters are aout a useful as the paper they are printed on. Should send them, yes. Is the collection agency going to stop calling, maybe, maybe not. If they don't stop calling, what are you going to do? (find a lawyer to sue under FDCPA, good luck).

            If you don't believe me try it for yourself, it worked on all the collection agencies I sent it to.What do you got to lose, but less collectors calling. This is not for original creditors.

              This is letter is exampled in many places.

              While it may get the collection agencies to stop calling, it also does not let them know your intentions with the debt. Rather telling them that you are filing from BK is much more effective. We were getting close to 50 calls a day( I think 48 was the highest) now we are only getting 2-3 and I'm trying to catch those calls also.

              Being honest with your intentions is far better.

              Oh, and be on the lookout for certified mail or open & read carefully all your mail, because after sending the letter you can be sure that they will contact you.

                I am not saying it never works, in fact, many collection agencies will comply...and then sell it to another CA who begins collections and starts the cycle over again...but members need to understand the challenges faced with collections

                There is a big difference between "exercising" your right and "enforcing" your right.
                Sending the letter is only "exercising" your right, whereas if the collection agency does not comply, then you are faced with "enforcing" your right, which is where a lot of people get frustrated and blanket statements like yours, "How to stop collectors from calling, for good" are misleading.

                Should you send the letters, absolutely, but don't harbor the illusion that a simple letter is actually enough to get ALL collectors to stop calling.

                  I let them call and they call a lot, but I don't use my home phone. I turned my ringer off and left it go to voicemail. Everyone else calls me on my cell or at work. The letters sound like a great idea, but a lot of work.

                      If you avoid the calls, your run the risk of them calling your family members, friends, neighbors. Not all will, but one of mine even after I talked to them during the previous week, called my siblings in different states.

                        Our neighbors were called as well a couple weeks ago. Neighbor lady came over with a sticky saying someone said they were dealing with something with my husband. Uh yeah, as if that doesn't just yell "DEBT!!!" LOL

                          This letter has so many flaws I'm reluctant to even engage in a dialog about it.
                          filed chapter 13..confirmed...converted to chapter 7...DISCHARGED!

                            I just wanted to point out, in case anyone stumbles upon this thread later, that if you are sued over the debt, this letter basically acts as an admission of the debt and probably gives the plaintiff all the proof they need to succeed with a motion for summary judgment against you.
