    Nat City auto Repo - how long after discharge?

    I stopped paying on my SUV in July 2008, voluntarily surrendering it in August 2008. I filed bk7 12-22-08. It was included in the bk as surrendered as well. On my credit report, nat city reports it as "bankruptcy" and closed already. I called the bank last week and they said they closed it out in October with no further action.

    I called every Friday for a few months before filing and they kept saying "we'll forward it to the Repo dept".... I have updated my address, phone numbers, etc... and even though I was discharged 4-16-09, havent heard a peep from them.

    My Lawyer says that they might not ever come and get it. In 3 months, it will be a year since Ive made a payment on the SUV.

    It sits in my garage w/no insurance and expired plates. Does anybody think its safe to update the plates, insure it, and start driving it? Anybody with experience with Nat City and auto repossession? Is it possible they are leaving me with my 2002 GMC because maybe its not worth it to them to come get a 7 year old SUV with high mileage? I only had a year left on the payments before I filed....

    A friend of mine went through 7 in 2004. She had a little car she owned about $4000 on and it was to be surrendered in the bankruptcy. The car was a 1997 model, had close to 200,000 miles on it at the time. The bank declined to pick the car up. She was discharged in mid-2005 and still had the car. She continued to drive it, and at one point bought a newer vehicle. When her daughter was old enough to drive, she gave the little car to her. They can't sell it, but they can keep renewing the tags and insurance. The car is pushing 250,000 miles today and still going strong. Her daughter wants to trade it in but can't. The bank doesn't want the car. She offered to bring it to a nearby branch and they told her they would have the police tow it as abandoned because they no longer have a valid security interest in the vehicle. Very odd behavior IMHO. But as long as it runs, might as well use it, right? Would be nice if they'd just release the lien on the title for her!

      Im going to give it 1 more month.. if they dont come get the PIG by May 15, Im going to re-insure and re-plate it and drive it. Like I said, in July it will have been 1 year since I made any payment on it. Its probably only worth $3000-$4000 at auction, maybe less and is a 2002. Maybe the bank will just wipe their hands clean of it afterall.

        Well Nat City must monitor this website!! LOL On Friday I received a certified letter from them with a letter stating they know Im discharged from my bk and want their collateral back. I called right away, it was afterhours, and left a message. If they are coming to get it, I just want it gone so I can move on with my life (and clear up room in my garage!) lol.
