    great phone fight with NCO

    Oh what a night!!!

NCO called and I answered the phone to pass on my atty's name & number.
I found out that they were calling about a checking account that was closed with a negative balance.
I had been back & forth with the bank requesting the acct to be closed. That I would honor the checks that I did write. Various debits came through my account (after talking to creditors to no use this acct anymore) and all the items were returned NSF with $35 fee. Well over $1,200 worth of fees later they close the account with a negative $ 1,700.

I am still willing to paythe $500+ to honor my obligations. No one wants to make the deal.

The collection girl was totally understand and knew exactly what I was saying and agreed but needed to get okay from supervisor.
So, as the "supervisor" got on the phone with the nastiest remarks of "cleaning up my mess for me, he is willing to slide a deal of letting me pay only $1,000". He went on with other not so nice comments.
I told him either take the$500+ or talk to my lawyer.

The first one I talked to said it was not reported to Chexsystems. The guy supervisor said it was already reported.

So......uggghhhh. Why did I bother to answer the phone?

    Okay, done venting, carry on.
    Have a good night

If its with NCO due to NSF fees...then yes, it probably is with chexsystems.

If you want, you can pull your own chexsystems report and check it out for sure
Or you just add it to the BK matrix and clean up your report after your discharge.
    Filed CH 7 9/30/2008
    Discharged Jan 5, 2009! Closed Jan 18, 2009

I am not an attorney. None of my advice is legal advice in any way..

Yes, I figured it was with chexsystems.

I told they guy "talk to my atty". I already had it added with the papers the atty has.

i always thought that once you closed the account, that you wouldnt be responsible for a debit transaction, only written checks..

I had this same problem with NCO, and a charged off checking out. The problem I had was the bank sent me to a collection agency, so I included the collection agency in my Ch 13 plan. Well, after a year of being in my plan, the collection that I included in my plan, who in return, did not file a claim to be paid, sold this debt to NCO, who tried to collect on the debt. I gave them my case#, and my attorney's name, and phone#, and never heard from them again. NCO is a nasty company to deal with.

When I tried to close my last bank account they said they would reopen it if any transactions hit within 30 days. So if a creditor has your info this becomes impossible unless you jump up and down and yell identity theft at them. Then they will do it. :-)
filed chapter 13..confirmed...converted to chapter 7...DISCHARGED!

I agree NCO is one of the nastier collection agencies.

Looking back, I really should have told them my checkbook was lost or stolen and that at least would have pushed them to actually close the acct.

You did good. You see, getting half of something is better than getting all of nothing. Their attitude lost them $500 bucks, the only money you really owed, but I am sure you made good the returned checks (that were not supposed to be returned as they agreed you would make them good), so you really owe nothing. For them to just put charges on anyones account is not right. Let them eat shi*, in your bk. 'Hub
If I knew it all, would I be here?? Hang in there = Retained attorney 8-06, Filed 12-28-07, Discharge 8-13-08, Finally CLOSED 11-3-09, 3-31-10 AP Dismissed, Informed by incompetent lawyer of CLOSED status, October 14, 2010.
