    Compass Bank Just Keeps Harassing Us

    We filed Chapter 7 in early March.
    When Compass Bank called about their Visa less than a week later I told them I had filed but they would not take the BK number from me as they had not been "officially" notified.
    Fine, I immediately sent the BK number to them online at their website linking my account number of course. And I have done this a total of 4 times now since we filed, they don't seem to care.
    Last week early it was a certified letter from an attorney they hired to collect. My attorney sent out nasty notices to all.
    Today I get certified letters from the bank directly telling me that they are going to sue us as all other efforts have failed. (Our 341 is next week).
    I cannot beleive their persistence and stupidity in this matter and constant violations of the court stay.
    I called the attorney's office and he says that they will regret this action. I don't know what that means but I am getting really tired of them. I guess the courts can fine them but I am not sure.
    I guess it's this type of stupidity that got the banks in trouble in the first place?

    Bk judges HATE creditors who violate the stay blatantly like this one is. Start working with your lawyer to figure out a response that forces them into court to get a scolding from the bk judge face to face.

    Unless you suffer damages from their violation of your stay, there's no money in it for you although Compass would likely get to pay your lawyer's extra fees and the court costs. Emotional distress alone as damages has been tried, but hasn't been very successful.

    Just curious....is Compass Bank a credit union?

    09/27/07 - Confirmed at last!
    06/10/11 - Trustee confirms all payments made
    08/10/11 - DISCHARGED !

    10/02/11 - CASE CLOSED
    Countdown: 60 months paid, 0 months to go

      Go get them. It is a blatent violation. You know, something like not paying your income taxes and then becoming the head of IRS. Just burns my seat up. 'Hub

        I wouldn't get too excited. I would do my best to view this as an income opportunity. If they actually go ahead and sue you, cha-ching. You can ring the register for malicious prosecution and mental/emotional damages. Just try to get as much of this on paper as you can. It will probably amount to nothing but it just might be a nice little post-BK nest egg for you.

          OOOOHHHhhh, a man I can relate to. Very good idea. In fact, it just may get the attention of others and help many. At this moment, I would love to trade places with the Op in what I have learned here on this forum.

          Now, how do we cure these MIA lawyers. I had one I dragged through the Court when I was already discharged but didn't know it. I take a bit of satisfaction on putting trouble towards a target that cause us much trouble through our ignorance. 'Hub

            that is so bizarre. When my creditors called me and I gave them the info they were so happy and polite and wished me luck.
            Very odd that they continue to do this . . .

                Citibank called us yesterday. They left a message demanding we call them back before midnight or all hell would break loose. Obviously, Citibank neglected to state in the message who they were. I called back and the computer wanted first my Social Security number then our zip code. If we put in wrong numbers, we would get disconnected. What they wanted was only me, and me only to call them. The number they wanted me to call was their bankruptcy section.

                  Sure, most of these in-house collectors are happy when you tell them so they can stop wasting their time on you.

                  It's actually kind of funny when they get all indignant and start huffing and puffing about "sir, you have to do something about this debt" and I just shrug and tell them "oh, really".

                  I had Discover on the phone yesteerday, and this girl was trying to convince me that I really should care that the account is charging off next month. I told her look, honey, I have Parkinson Disease and I'm in the process of getting scheduled for brain surgery in a few months, nothing you have to say is really going to scare me in any way whatsoever.

                  They love it when you call them honey or sweetheart, by the way.

                  I kept her on the phone for about 30 minutes while I was browsing this neat website I found which has all kinds of stuff about abandoned airfields, state by state. I would rather be playing yahoo chess but it's too hard to play while talking to them. This is the website, by the way: http://www.airfields-freeman.com/index.htm
