A good attorney will advise you of your options; whether or not he/she feels you should or should not file bankruptcy under your specific situation. No one is stating you HAVE to file - the information from meeting with attorneys gives you a base from where to start. Ours did that and explained how each situation would or would not work and how filing Chapter 13 would be the better option for us and that going with something like CCCS would not work. Ask questions and that is how you will learn what will work for you but meeting with a few attorneys is the only way to really find out what you can and cannot do as to your own particular situation.

Most people pay for their attorney by utilizing the money that is freed up by not paying the credit card bills. When you stop making payments on all the bills it frees up a lot of cash. However, as I mentioned previously, don't stop making payments on your secured items until you meet with an attorney and decide what you want to do.

The loss mitigation department only helps you if you are behind in your mortgage. (And that is a rare event - the helping part).

But, find out if your loan is Fannie Mae or Freddie Mac because those programs require you to be current and you are - they are better programs to start. Go here for info:

I am not an attorney. None of my advice is legal advice in any way..

Thank you all for your help.
As was noted, get two or three free consultations with bk attys. Go with the one you feel most comfortable with.

Dont worry so much about the house, as long as you keep current on the payments you will be able to keep it (I did).

That zeror card with 17k on it is disconcerting. If/after you filke bk you will have to stay away from those. They are so tempting and are a pit.

God bless and happy easter. Things will get better.

jacinta, go with the been-there-done-that advice above. But, for what it's worth, I, so far, expect to keep my one toy- a cheapo pop up camper. all depends.
