bankruptcy-property settlement as a result of a divorce?
A friend of mine just went through a divorce. A judgement in family court granted $30,000 to her ex spouse for a property settlement based on the sale of proceeds on a condo a couple of years ago. My friend was suppose to start payments of at least $200 a month in September of 2008, but no payments were made as of yet. She's been working every now and then and since remarrried. Her new husband owns his own business. She recently filed for bankruptcy Chapter 7 as an individual. I'm not sure how many creditors are involved. A bankruptcy hearing will occur in a week or so, which I think her ex-husband plans to attend. Are there grounds for discharge in bankruptcy court with regards to a property settlement judgement as a result of a divorce? I understand all creditors have some time to respond to the discharge. Does her ex spouse have a good chance to collect from her?
