    how much time do I reastically have?

    Some background info. I started paying my creditors less than minimum since the beginning of the year because that's all the money I have. Of course, the calls started and any attempt to come to an agreement was futile.

    Three months later I finally decided to file for BK because the banks were absolutely disinterested in working with me. Discover already charged off our account and handed the debt over to wonderful Mann Bracken. I assume others will follow suit very soon. Since I have to pay my lawyer I now stopped paying my creditors anything at all (with the exception of student loans).

    The attorney will not file the case until I paid him in full, i.e. I have to sit it out another 4-5 months. How realistically is that? What are the chances that I will be dragged into court, or worse yet, have to face arbitration, have my wages garnished or bank account frozen? My lawyer says not to worry about it because it's going to take a while to get a lawsuit together and I'll be filing before they can do anything. Should I trust his word? Is there anything I can/should do to delay any actions the creditors can take?

    We stopped paying in late Sept. 08. Calls started immediately and gave them Attorney's name, address and phone number. Paid Attorney in full, but have to wait and file on 9/30/09 to let some income drop off.

    I've had one phone call in two weeks and have received 2 letters from collection agency on accounts we owe less than $1,000!

    When I got the first collection letter, I faxed it to my Attorney. He emailed me back and stated for $60 more he could file something in Court that would delay until we file on 9/30 using my husband's income from Apr-Aug. 09.

      You have some time-likely 6 months or more.

        We've not heard really from anyone since giving them our atty's info which was late January, with the exception of HFC. I gave them atty's info, they in turn hired an atty to collect the debt. I gave him the atty's info that HFC somehow "didn't include" in the file. Then 2 weeks later that same atty filed suit and I was served. I guess they were just trying to call my bluff? Who knows. All that and I'm just barely coming up on being 5 mos behind. Whatever though....we're filing in a couple weeks and they won't get anything from me!
