    Retaining a lawyer

    When you simply retain a lawyer, will creditors stop harrasing or do you need to file first?

    I'd like to retain an attorney but will probably not be filing for a few months (my husband has been working a second job to try to keep up with things, but we're still not making it so he's quitting) but I am sick of the calls. Can you just say "I've retained an attorney" or do they want you to have actually filed before they stop?

    Once you retain an attorney many of the calls will stop - but not all of them. It depends upon the creditor. It does make it much more bearable for those months leading to the filing to be able to refer the creditor calls to the attorney.

    The filing stops the calls!
