    Normal Atty procedures?

    HI...This is my first post after lurking for a while reading up on finally deciding to take the bankruptcy plunge.

    My first(of probably many)questioins is this...

    About a month ago my wife and I had our inital meeting with the atty we chose. He told us to fax our end-of-month paystubs and then make a follow-up appt to discuss where we would go next(CH 7/13).

    At our next meeting he looked over our stuff(our impression was it would already have been reviewed) and said he would give it to one of his assistants the next day to compute our CMI(or maybe DMI?) and we would hear from them by Friday.

    By Friday afternoon I had heard nothing, so I called the office and was told by the receptionist she would talk to the atty and have him get back to me that day.

    Didn't hear anything by close of business Friday, so I called today and was told by the person who was supposed to compute our paperwork last week he would look into it and get back with us either today or tomorrow.

    So my question is, am I putting unrealistic expectations on this whole process, or does this office not seem to have its affairs in order? It is a firm that does bankruptcy only and has been around for awhile.

    This is not a normal procedure. Normally when you go to the initial consult the attorney is able to review the information you bring (income, assets, and all of your debt) he is able to tell you right away whether you are Ch 7 or Ch 13, or a borderline case.

    I would not trust any attorney that could not figure out which way to go on the initial meeting. It almost sounds like you are dealing with a BK mill type place and maybe a 'newby' spoke to you? Hard to tell from your post, but we are talking basics here.
