    leins on credit report...

    if you are sued and a lein is put on your house and its not collectable unless you sell the house in florida due to homestead, right?

    ok, will this lein show up on a credit report?

    im thinking about not filing BK in the immediate future. since i have an ARM mortgage and very little equity, just walking away from the house in a year or two..

    so the house goes into forclosure and what happens to the lein? does it continue on your credit, or does it die with the mortgage?

    Liens are recorded with the agency/department that keeps such records in your city, town, municipality, county and/or State.

    Generally, it's the Clerk of the County that records such information. It is placed into a "book" and has a "page". These records are public information and most of them can be accessed on-line quite readily.

    Now that I wrote that... the creditor who is trying to collect money from you, may also add a "collection" entry to your credit report. However, that is not a lien.

    If the house goes into foreclosure, then the judicial lien would fall off. The lienholder would have to look for other property to lien of yours.

      i have a judgement, it is on my credit report and will stay for seven years, altho the lien is valid for 10 years. losing the house has no effect on the lien, it will still stay on credit for 7 years.the judgement is against you, not just your house. the lien shows separately from anything else on credit report.

        also, having the lien on your house, does not mean that they wont also try to get you bank accts, or other assets, the lien is just one way to try and get their money, which ever works first is fine with them
