We are below median income and want to file a Chapter 7. As I have mentioned in other posts, I am concerned that we could end up forced into a Chapter 13, because for some reason the attorneys in this area don't use IRS standards and cap living expenses at a low amount and then don't allow for basic expenses such as hygiene products and household supplies. Anyways, almost all of my student loans are in a grace period until mid-June, at which time I get hit with the full force of payments, which will be very high. I could, in theory, consolidate my student loans now, which would end the grace period and start all repayments. If I did this, then my disposable income would be very negative, even with the attorneys packet of what they consider reasonable expenses. Does anyone know how this might be viewed by the Trustee? Woud they assume abuse for consolidating my student loans? I HAVE to consolidate before I can pay them back anyways, so it makes sense to me to consolidate now so that I can list it as an expense on my packet. Can anyone help? Thanks.
