    Figured out the HUGE refund problem....I think

    Now that the attorney has a complete picture of my family (son) situation, and the need for a wheelchair, here is his suggestion.

    Take the $15K, buy a van, have it titled in both me & my wife's names, then do the required mods for wheelchair use (about $2-3K for a lift)

    By having both spouses on the title, it helps "shelter" the van from being grabbed away, and also solves our "reliable, functional car" for my sons transportation.

    This is a strategic move, in case the trustee is anal about the 10K fed exemption on any property, since I am letting the real estate go.

    By the way, I am thinking of getting a 2005 Honda Odyssey EX-L from the auction, where I've been told they can be purchased for $10K with less than 60K miles

    What's your collective opinion on this? (FYI, my wife is clean and not included in any of my creditors files)

    Sounds like a strategy. Besides, you'd probably still be able to use the Federal Unused Homestead Exemption and apply it to the van anyhow. Then, you have the "necessary implements" for a disabled person or dependent.

    Overall, I think it's better to have a reliable vehicle anyhow, and no one will fault you for that.
