    What Creditors were the hardest on you during the process

    Was it any paticular bank, credit card company? Or storefront lender like CitiFinancial? Beneficial? BestBuy?

    I guess we are just trying to mentally prepare ourselves!

    Thanks for any feedback.

    None... and some of my large creditors were...

    Deutsche Bank (2 Homes/3 Mortgages)
    American Express (2nd only to Deutsche Bank Mortgages)
    HSBC Auto (2 Cars)
    CitiFinancial
    Home Depot (GEMB)
    Lowe's (GEMB)

    You have to remember that Bankrutpcy is a technical process and these creditors know what it means and the implications of rocking the boat. I would say that the only time you'll have issues are...
    1. You made charges from a single creditor aggregating over $600 within 90 days of filing
    2. You made cash advances in the 60 days within filing
    3. You purchased luxury items from a single creditor over $750 int he last 70 days
    4. They can absolutely without doubt prove fraud
    5. They are a secured creditor and don't think you should be cramming down their claim or avoiding their lien

      My wife had a target card and they actually called my mother in-law after the second missed payment. We had decided to file and stopped paying credit cards. After we told them we filed or would be filing they left us alone. Just try to surprise all your creditors by filing

        Target is pretty aggressive with their calls. They started calling me the very next day after the payment was due! And like 6 times a day! Once we told them we were filing, the lady was very nice and haven't heard from them since.

          Amex and Chase were relentless on the calls, even after we told them we retained an attorney to file BK.
          May 2008 Hired 1st Attorney/Stopped paying CCs
          May 21, 2009 Retained 2nd Attorney
          May 28th - Filed for Ch 7 (FINALLY!)
          9/11/09 - DISCHARGED!!!!

            For us everyone was pretty relentless with the number of times they called, but I really only had a few people be rude from the OC's, one at BofA, one at Citi. Discover used to leave static on my voicemail about 3 or 4 times a day, plus the other 10-20 hang-ups per day, but when I actually talked to them they were fine. Juniper is the account that I talked to the very least, because the rep I got there several times was very manipulative, so I just stopped contacting them.

            Now that we have some cc's with CA's, it's about 50% ugly - two in particular (Van Ru & North Star) were very agressive & rude... not talking to them anymore either...

                I owed a lot ($1 M) and no one objected at all in the BK.

                I think if you go in prepared and with everything disclosed you have very little chance of getting challenged. The more documentation you have, the less they challenge you. IMO. It seems that the lack of documentation is a red flag for Trustees, they make assumptions and there is no paperwork to back up your position. (That is what jessiegirl is having to live thru right now).

                Of course if you have charged on your cc's recently, or done CA's or BT's or transferred assets...that is a different story.

                  Bank Of America was the worse when it came to sending letters, even after he told them he was filing bk but everything stopped with the credit cards once he was put into collections and he hasn't heard a peep out of any of them since. Chase was the worse when it came to calling.

                  He has quite a few local creditors, some don't know about the bk yet but Citizens Bank, his old bank, is playing games. Granted they want $850 in NSF fees on his account which he is including but they tried to make him pay another $200 in his checking account and they won't explain what the bill is for and lie in the letter saying they have tried calling "several times" to "discuss" the matter but they never called.

                  He hasn't filed with the court yet but I feel some local creditors may be there, I don't know if any will object. One threatened him with a lawyer but that's about it.

                    This seems to be a common scheme...they do this because it looks like they tried to contact you when in reality they have not. I always answer the phone because I have a home office and needed to answer. Many times the CA's or OC's just hung up when I answered! So now on their database it looks like they tried to contact me, but did not get through. It does not make sense to me.

                      All my debt was unsecured, except my house which i kept.

                      Citibank was very nasty, said I committed fraud, etc.

                      Bank of america was very very very persistent, but reasonable, they settled 40,000 for 6,000, and were consequently the only one who got anything. Before I knew bankruptcy was going to happen, wasted 6000 on my part, but they were shrewd and professional, probably saw bankruptcy coming when I didn't

                      Citibank eventually filed the suit that go me into chapter 7.

                      One creditor said "my neck is in the noose" which I have recorded. I record all calls into my phone with special software. It is interesting what was said, someday I will go listen to the highlights again.

                      Discover actually said I needed to file bankruptcy, I thought I could work my way out, but they were right.

                      Overall I discharged almost 200k in unsecured debt based on the inflated balances claimed. I think I charged more like 140k because i thought I could play the game before I lost my job.

                        Really? I should have known and I'm sure the random $200 they want is probably a scam as well. The only time Citizens ever called was when he was behind on his business loan, I knew it was them because it would come up with their name and a Rhode Island number. Unless they are disguising themselves as the Unknown Callers that sometimes call the office.

                          all made call that were relentless, I unplugged the phone eventually.
                          Once I filed, none gave me a hard time.

                            The "best": Target! It's odd that you all had trouble, they didn't contact me ONCE!

                            The "worst": MY OLD GYM. They were total a-holes! They were harrassing my entire family and my former employer! It's somewhat funny, because they automatically renewed my contract when I had already sent 3 letters (two of them months before) saying I would not be renewing, kept trying to get me to pay them $500 to "break my contract" when I hadn't even renewed it (claimed they never got the letters and I hadn't talked to 5 people on their office staff, etc.) Anyway. They were lame. I wasn't even planning on including them in the BK, because I didn't technically owe them anything, but that was easier than fighting with them. Apparently they do that to a lot of people, so I suppose I got off LUCKY.

                              Any chance it was Bally's? The problems seem awfully familiar.
