In my case, I ended up moving a few times so my address and phone numbers changed. I still received letters from collection agencies but stopped receiving calls.

I filed pro se so I didn't need to pay an attorney. I am paying my filing fee in installments.
Filed Ch. 7 Pro Se: 12/11/08
    341 Meeting: 1/7/09
Trustee's Report of No Distribution: 1/9/09
    Discharged: 3/10/09

We stopped paying most cards around March 2006 and were never sued. Our trustee was amazed.

So far we have made it some 4+ months.
We turned in our home and RV. We could not sell either.
They just sold the RV and the home is still for sale.
We file in March for Chapter 7.
Our attorney tells us now that it would take longer to serve us and get us to court than we have to file easily.

The longest one for me thus for is Citifinancial. I made the last payment in August of 08. They haven't been paid since because we tried negotiating lower rates and payoffs with all of our cc before we considered filing. Once we decided to file in February we stopped paying everyone.

Citifinancial just wouldn't play ball. The balance was $6,200.00 when I stopped paying and it's now almost $8,000.00 - all fees and interest.

AMEX was quick to transfer us to their CA's who are threatening lawsuit. We'll be filed by the time they get to it.
                over $100K cc debt,$20K taxes,$332K mortgages/value $190K,surrendered
                Confirmed, $801/month 56 down,4 to go

It's only transfers that are big AND unusual for the customer habits that draw a red flag.

Well, unless you get an ass of a trustee :-)
How do "Trustees look for patterns"? Do they actually look at your credit reports to see when accts were opened, balances each month, etc?

                    ccmisery

The calls were crazy, I permanantly took the phone off the hook, once I told them I had hired an attorney and gave them his name and phone number the calls stopped. Phone is back on the hook and now it rings off the hook with solicitation calls as usual.

Funny, my car got hit in the parking lot at work, the person took off but another employee got his license plate. cops found him and his insurance co gave me $1424.08 for the damage. The lawyer cost $1399 and I gave the person who got the plate number flowers for $25. What a freaky coincidence that was!!!

My son hasn't made a payment of any sort since August 2005. To the best of his knowledge he has not been sued. Since all the CA's call here, instead of where he lives, I guess they haven't found him yet.

He's lived in the same place and worked in the same place for 4 years, yet he has never received a call. Lucky me, I get them all. I've never talked to any of them. I have a device hooked up to my phone where I can selectively not even hear the ring. The calls just ring off to oblivion.

I had a payment arrangement with NCO from a Citicard. Made payments of $450 starting August 08' and stopped in Feb of this year.. due to they only set up payment arrangements every 5 months or so and they have to renegotiate. I just can no longer continue to make payments. I tried working with one of their reps but they wanted $900 right off the bat. I have child support payments, dental payments, rent, food, clothing for my child. This is an old debt, I think the last purchase I made was about 5 years ago.

Single income, I owe over 10K to them.

I plan on contacting an attorney for advice. I hope I don't get an unexpected visit at my home or place of employment.

Was around 18 to 24 months after I stopped paying on 6 accounts before they served me. I received at least one collection notice a day in the mail. My number was changed probably 3x in that time, so they never bothered me by phone.

The first court order I received said I had to call the collector by a certain date. I didn't bother. Then it was a few months after that, that I was served with 3 court hearings in the same month, from 3 separate creditors. That's when I filed.

My question is, why not wait until you get sued and lose. Assuming that they actually are real lawsuits. Let's say you lose those lawsuits. When they attempt to garnish you then file BK. Doesn't that stop the process, and meanwhile wear out their resources a bit. In the war of attrition I want them to work the whole way and get very little payout.

Well I never put much thought into a game plan. My plan was to not deal with the hassle of court and taking off work. Instead, I filed, to end it before they had a chance to attack me. I feel they are all getting very little payout anyway, compared to what they paid to me.
