    they grabbed it quick...

    i have two motorcycles thru a credit union...i am current on one and three days late on the other...
    the lawyer said that i cant keep luxury items and they must go...
    i am in the process of moving and the house is also going...
    so, i called the CU and informed them of the bk forthcoming...
    they wanted the late one right away, so i dropped it off to them, with the keys.. it just got it out of my way...

    the second one, im going to keep until someone tells me to give it up, since the payments are current..
    i see that i have a registered letter waiting at the post office from them... i cant pick up the letter till monday.. i wonder what it says......

    Do you have a car also that you are planning to keep after filing? If you don't, then you are allowed to keep one if it's your main transportation.

    This is one of those variables between trustees and bk courts. Sounds like you have a local court that is strict about these kinds of assets.

    You'll likely find out at your 341. Your trustee may tell you that if you want to keep the motorcycle, you'll have to pay him/her the value of the motorcycle to keep it.

    Keep in mind that it's just a thing that can be replaced after you are discharged. Does it have some kind of sentimental value to you that makes it hard to give up to get a really fresh start with less debt?

      Although we have no wild card here in FL - only $1,000.00 for personal goods and $1,000.00 equity in a car - if you are not keeping the home and therefore not using a homestead you can use $4,000.00 of that for other things. - jb

        Yep! That $4000 goes toward all your household items, clothes, cash, etc. Imagine - your entire life assets within $5000 total exemptions! So in Fl - when you get your CH 7 discharge you are really starting over! (Don't mean to sound negative, it is just a little frustrating)
