    Saw Attorney Finally

    After waiting 6 1/2 weeks to get into my first appointment with our attorney I got some answers in addition to what I learned here and some I researched myself. Don't be surprised if you find out that your waiting time is long too. These people seem to be very busy with the current problems our country is in.
    My wife had lost her job due to medical reasons in late Sept (I am already disabled and cannot work and longer) and with that it put us over the median for this area with our retirement (not SS in this case).
    It seems odd that they don't count SS against you for filing as income but they do count retirement from all other sources. It would seem retirement is still just that and I don't see a difference as to the source.
    I don't like having to go back 6 months for income but that's the law so we have to wait until after March 1st otherwise it's Chapter 13 which I would rather not deal with.
    The good news is that the attorney tells me that in my case even though we have not been able to pay secured and non secured debts since Oct that will be included in the BK. We have also not been served yet by anyone nor have the secured items been sold so there is no deficiency balance established there yet.
    The attorney tells me it takes 60-90 days if everything went really quick to get a judgement to attachment my checking account where my retirement has no choice but to go so we should be OK.
    It makes me feel a little better at this point anyway.
    I wish it were all over but that time is coming~~just a little longer.
    If you are involved in this process hire an attorney. It's worth the money or at least it was to us for peace of mind.

    We're with you, looking to file March 1. Our attorney was only 1200, total, spread over 3 payments. Worth the peace.

      And ours was $1500. Had to get out of town to get one that cheap as most in my area wanted $2500-3500.
      I am glad some one's business is good.

        Yes, the BK attorney's in my area seem to be busier than a one armed paperhanger!!! Guess we can estimate the state of the economy by checking into how busy the BK attorneys are...

          Yes I heard on the news station out of Phoenix that the BK filings for Nov were up some 40% over the same month last year.
          They even went as far as to say that figure will double, or it's estimated it will, by next Spring.
          I guess that's my group too.
