Thanks for the feedback.... Good to know I'm not alone! I'm meeting with another lawyer tomorrow to discuss our options.
Here are my next wave of questions that I will ask tomorrow. I'm not sure if a lawyer can legally answer all of these questions?
1. I need/want to use my mortgage payment as a deduction. What happens if I do a "ride through" on the mortgage and then walk away after I file? Basically how do I use the mortgage payment on the means test or against my DMI if ultimately I want out of the house. Doesn't make sense to me to try for a fresh start in an upside down house - with a crazy payment($2850)
2. What legal ways can I lower my dissposable income? I won't be filing for at least 6 months. Life insurance, tax with-holdings, 401K, etc....
3. At what point should I stop paying my bills, after I know for sure what month I am going to file. If I am going to file in 6 months can I stop payments now, if so on what? unsecured, secured, etc...
4. The whole dissposable income (means test) thing still has me confused? Do they give you allowances for internet, satellite, pet supplies, entertainment, etc? I know we are in a down sizing mode, but to have no monthly budget for entertainment seems tough to manage.
5. If I were to become unemployed, wait 6 months and then file. At what point would it be safe to return to work without jeopardizing a BK 7. Am I sagfe after the 341 or do I have to wait until I am dis-charged?
I'm going thru the overwhelmed stage right now, I've read and learned a ton on here - thanks for all the feedback and advice! This board is like a crack addicition (not that I would know about that though), I read on here for hours every night, lol.
