PACER question?

    PACER question?

    So I don't rack up a huge bill, what query items are the ones to check on to make sure things are going smoothly? I didn't want to click on each one and owe a ton of money, I am mainly looking for errors or things to be concerned about.

    Also did anyone notice it states under federal law that ONLY Attorneys or court officials are suppose to be using it?

    In the beginning I looked at every thing, every day. Now I'll run the query for the case and see the last date that was things were updated. If something's been updated, I look at the docket. If nothing has been updated for a few days, I might look at the claims. Rarely do I look at anything else.

    Anyone know when PACER gets updated? Random? Always at 4pm? Etc?

      I read somewhere on the site that PACER is "real time".

        I looked at my PACER today, since I surrendered my house last week or so is this a normal entry?

        12/18/2008 10 Notice of Appearance and Request for Notice Filed by Creditor CitiMortgage Inc.. (Jones, Tyler) (Entered: 12/18/2008)

        I looked at the document its some kind of court request from the mortgage company. What does it mean?

          Ugh, hopefully someone knows whats going on, my wife now mentioned maybe they are trying to get us pushed into a Chapter 13 so we have to pay them back!

            All lawyers must enter a "Notice of Appearance". It's a procedural thing. In open Court, you'll hear the Clerk ask "all parties in this proceeding please come forward and enter your appearances". It's a formality.

            Specifically to your PACER question on what is the Notice. It just means that a.) the lawyer represents the creditor and b.) the lawyer wants to be sent all copies of anything related to the case for a specific Creditor. That's s it... nothing else.

              If I am a filer, wouldn't my access fall under "Official Court Business", especially if I am pro se?

              I thought Pacer was real time?

                PACER (aka CM/ECF) is updated as soon as the Clerk's office updates something and releases it. It can happen at anytime during the day.

                Claims can come in at anytime during the day as well.

                PACER is the Public Access to Court Electronic Records. It was combined with the Case Management/Electronic Case File (CM/ECF) system so that it's now just one system. Lawyers, judges, Clerk of the Court, Trustees and other people admitted to the bar or that need access, have full CM/ECF capability and can file all their papers (pleadings, motions, etc) electronically. As a point of fact, in all Districts... any lawyer admitted to practice before the U.S. District Court must submit their papers electronically. We pro se filers need to submit everything on paper still.

                  Do you think its possible Citimortgage could try and get us kicked out of our Chapter 7, or is that impossible and completely up to the trustee. So I am guessing its nothing to worry about?

                    Nope. They would file an Objection to Discharge, not a Notice of Appearance, if they didn't think you qualified for a Chapter 7.

                    You can relax, for now.
