    Can you give me some peace of mind?

    Hello! My husband and I are planning on filing for Ch 7 Bankruptcy. We rent an apartment at the moment, and own a 95 Corsica and 04 Cavalier free and clear. Combined we owe $26,000 in unsecured credit card debt. I am currently being sued by my landlord from college last year along with the 4 other girls I lived with (long story) for $12,000 (WAY more than the rent I supposedly owed!) and also being sued by my college for $5100 in unpaid tuition (not in a student loan, just my student account). Also, two of my husband's credit card companies (Washington Mutual and Chase) are trying to sue him now, too. We just filled out an application for a new house to rent with a friend as a roommate to cut costs and are hoping we can get approved for that (our friend has good credit). Our lawyer said that once we get a new place to live, we can just include the unpaid rent from our current lease (in our $700/mth 1-br apt) in the bankruptcy. I have been unemployed since September and get approx. $200/wk unemployment and my husband works at the college I went to, making about $17,000/yr. Anyway, my 3 biggest concerns are:

    Can we actually include the rest of the money owed in our current lease (which would be up in May 09) in our bankruptcy filing?
    Can I include the $12,000 from the former landlord's lawsuit in the bankruptcy?
    Can I include the $5100 from the University in the bankruptcy since it isn't a student loan? And if I do that, would I still be able to finish my degree there?

    Yes, you can include contracted amounts.
    You can include the lawsuit.

    I am not sure about the loan from school because I dont understand what it really is.

    From the sounds of your situation that you have written so far, it sounds like a clean no asset ch7 depending on your state. It just sounds like you waited a bit too long to file with all those suits looming over you. It might cost a little more to get them out of the way is all.
    I hope that gives some peace of mind for awhile.

    Another thing that will help is to check with several attorneys for their opinions for some peace of mind on that best way to handle things along the way so you do not make any mistakes.

      The school might give you touble!

      Otherwise everything else seems doable. Be sure and check the exemptions for your state with your cars.
