Ch.13 - - > Ch.7, still not filed, want to stay in the home

My income is just above the means for the state.
Yet when my lawyer tries to put my Chapter 13 filing together, there are no funds available for a monthly payment to a trustee.

I am going to then file chapter 7, do you suppose I can keep/stay in the home???

Is it all the decision of the trustee?

Depends on a lot of factors... Is there Equity in the property?
