Three accounts with the same finance company...is this trouble?

    Hi,

We will be filing ch 7 after the holidays. I'm guessing that Citi Financial is going to be pretty mad, because we have three accounts with them that are all being either discharged or surrendered. Do you think because of this, they might protest anything? Not that there's anything we can do about it, I was just wondering. The total between all 3 accounts is about $35K.

Well, they can be mad all they like. Can they object? Sure, but not just simply based on the fact that you aren't paying them.

They need a grounds to object, such as purchases or cash advances made within a certain time frame up to filing (usually luxury purchases are the big red flags).

Citifinancial was one of our creditors when we filed our 13 3 years ago. They were the pitbulls of our creditors, as far as phone calls went, until we filed, that is. They even called my mother in law- who's in her 80's, and got her all worked up.

The best part was, they filed their proof of claim late. I brought it to the trustee's attention, and he filed an objection. They got NOTHING!!!!!!!!!!
Didn't save us one dime, as their amount was just divided up equally between the other unsecureds, but it gave me a sense of satisfaction nonetheless!

You can't have your cake and eat it too. But you can dip your finger in the bowl and lick the icing

each account is viewed as one debt. they dont lump all three accounts together to gang bang and make that one debt just because it is the same company.

They still are one of the pitbulls. I think Chase is right up there at the top now days.
