Like a lot of other people these days I am really $$ hurting. I am purchasing my home and have fallen behind quite a few months, I have a company threatening to garnish wages about several medical bills, all my bills are pretty much behind, I have several collection accounts out there also.
As you can see I am trying to get myself headed in the right direction financially. I have 2 kids and am engaged to my fiance but we can't get ahead. Or when we do get one thing caught up another thing falls behind. I am betting I am about 10,000 in debt. I have a fairly decent job so I do make $$ but my 18 month daughter unfortunately has had quite a few medical problems that require a lot of traveling which costs us $$$ even with insurance.
My fiance himself has filed Chapter 13 a couple years ago over a repod car after the birth of our son and is on the verge of improving his credit score. He actually was preapproved for a home loan a month ago but with the credit problems all over they wouldn't do it without perfect credit and 5% down. It's a good thing in my opinion cause we need to get my finances situated first. He is about 1/2 way through his Ch. 13.
Anyways I told him I have called for someone to call me tomorrow about discussing the possibilities of filing Chapter 13 bankruptcy. My fiance says I should do Chapter 7. I read online that you have to be current in mortgage payments to do the Chapter 7 which I am not.
Can anyone offer any advice as to which way is my best bet? I don't want to lose my home in the process and I have 2 kids to watch out for also which is why I am biting the bullet and doing this now.
