As soon as you officially file, those fuc---s will stop calling. I don't know what changes are in effect since the Bankruptcy Bill was passed. I filed in '02 when the bill was bouncing around in Congress. I followed it in the papers then. The author in the Senate was Joe Biden. What a smuck. It favors the big banks like MBNA which his son, Hunter Biden lobbies for. One sponsor in the House was Democrat Rep. Jim Moran who had a deal with MBNA. He got himself into serious money problems at the time. MBNA lent him big money (to me) at 5%. My deal with MBNA was close to 25%!!!!
Talk about dirty.

Also, it needs to be known that another major reason the laws were changed was due to the rampant filing abuse and fraud taking place prior to October 2005 (mostly in Chapter 7 filings). Our own attorney when we filedin 2002 told us all about that and something had to be done. Those filing for legit reasons now to get back on their feet are paying the price for those that abused the system in the past. Blaming politicians alone is not the answer.

It's all dirty

From what I've read, there's very little evidence that there was much fraud before the bankruptcy reform passed and very little evidence that the bill did much to curb what fraud existed. I'm not a very political guy; I don't intend to vote for either major candidate in the election. However, I think it's clear that this was a law that was lobbied for hard by the major banks and mostly to increase their profit margins. Additionally, the history of the bill is quite clear: it passed because of increased Republican seats in the Congress and Mr. Biden, beholden to all those Delaware-based banks, voted for it.

It is true without Biden's support in the Senate that it would not have passed. Without the Democrats in the House it also would not have passed there. It was a collective agreement between both R and D to pass the bill to appease their lobbyist friends. So both are to blame.

Some reform was needed. I had tried unsuccessfully to get provisions added by NC's delegation to also put more responsibility on creditor lenders, to ensure they were not making loans that people had no means to pay.....obviously that didn't make it into the bill and that really was the greatest failing of the bill. As they say takes two to tango....
