Flamingo is right. It doesn't matter if it's not the original creditor, it's the owner or agent of the debt. We all got ourselves into this mess, and shouldn't be upset that creditors are trying to get THEIR money. Don't talk to these people, even if they are nice.

The title of this thread, "Apparently I'm supposed to starve and sit in the dark" is obviously someone trying to cope with the stress of the situation she/he got themselves into. IMHO, credit companies, society, and our leaders are to blame to a small percentage, but 70%-80% of the fault is ours for getting in this mess.

Why anyone would talk to an original creditor or collection agency is beyond me. All they want to do is get their money. Anything you say WILL be used against you. They are not on your side. It's a business decision, not personal. Do not talk to anyone on the phone, and keep them in the dark is my advice. The less they know, the better for you.

Here's the thing that irritated me. The more I calmly told the rep that they needed to contact my lawyer, the harsher her voice became. She at one point raised her voice, and I do not appreciate that in the least.

Yes, I know she is doing her job. However, I do not allow any one to talk over me, raise their voice or yell at me. That will result in my not responding at all.

It also irritates me that they chose to use the ruse of an emergency to contact me. I have a mother in law in a foreign country at the moment as well as a mother in a nursing home. I am contacts for both. So to use that ruse simply makes me want to not answer the phone the next time it rings because it could be a nurse or other worker at the nursing home telling me that my mother is ill or something has happened to her. Or someone to tell me that something has happened to my mother in law.

So while it is in their best interest to get their money, I have other bills that come first. I'm sorry I'm filing bankruptcy, but I have to make sure that I have my family sheltered, that there is electricity and that we are fed. If that can't be comprehended, then I feel sorry for anyone who can't understand that.

Sorry to sound harsh, but I've had my run of luck in trying to get the creditors to understand. I guess they're immune to the news.

Agreed about the emergency call crossing the line. That is undoubtedly harassment.

You will never be able to get a creditor to understand why you are not paying them. It's their job to only understand getting the money. Even the nice ones are not understanding, even if you think they are. They are fakes and only interested in money.

Don't talk to anyone on the phone. If they somehow get you to the phone, hang up as soon as you know who it is. Call your phone company and see if there's anything you can do about harassing calls that use the "it's an emergency" routine. Good luck, we are all going through these types of feelings as well, you are not alone.
