    How important is it to have a good bankrupcy attorney?

    My wife and I are boderline chapter 7 on the means test. We are over $400. We have a attorney who is a recent college grad which concerns me. Our good attorneys important to fight the fight when it comes to getting there clients to a chapter 7. My current attorney seems to be doing nothing to help up get over the hump.

    Well I would recommend that having a good lawyer is important depending on how complicated your situation is and if you need a lot of reassurance. The attorney I hired for my parents bankruptcy has been practicing for over a decades and is supposedly well respected according to his secretaries. But I still feel unsure and annoyed of the situation because you really never know how a lawyer will turn out until it comes to decision day. Unless someone gives you recommendations of course.

    How long have you had your current attorney? maybe he is still organizing your paperwork maybe? and yes usually lawyers are really adamant in trying to get you into a chapter 7 if possible, so maybe you should discuss this with him.

      We've had our attorney for almost a month now. The other problem I have with my current attoryney is that she does not return phone calls nor does she reply to emails. We are pretty much in the dark which scares the heck out me. I know the means test is just mathematical yes or no you pass, but doesn't a experience lawyer be more better in fighting our court battles? Am I wrong in thinking this way?

          In the end, qualifying for Chapter 7 is strictly a numbers game. Even a good BK attorney cannot argue a Chapter 7 filing into legitimacy if there are exemptions and expenses that cannot be justified - the trustee, in all probability, has seen all the "tricks" and examines the case from every angle. Very few cases are unprecedented. A good BK attorney will have no doubt about the outcome of a Chapter 7 filing long before the filing actually occurs.
