Converting from Chapter 13 to Chapter 7

    Converting from Chapter 13 to Chapter 7

    I would like to convert from chapter 13 to chapter 7. Do I need to file any paperwork? Or do I just pay the $25 conversion fee?

    If I have to file paperwork, which one(s)? Thanks!

    Basically you file the Motion to Convert and pay the fee.

    You may need to submit new Schedule I and J. You should ask the Clerk's office what you need. Generally, refiling schedules costs $26.00. You'll need to update your paystubs (if any) and other information (creditor matrix).

    Again your best resource, is to call the Clerk's Office. Specifically Intake should be able to answer. If not, ask to speak to a law clerk or one of the case managers for a "procedural" question. Different Districts have some strange requirements and forms (local forms) that may be specific to that District.

      Thanks Justbroke! Do I need to file a Notice to Convert too? Or is it the same thing as a Motion to Convert?

        Again, this may be a local rule (specific to your District). I'd ask the Clerk of the Court. See if they do it by Motion or by Notice. I think it's FRBP 1017 which is the guideline and you can just Notice to Convert using 11 USC 1307(a) which is your right to convert.

        From what I can tell, a District may or may not require you to file new paperwork with it (example, a 22A instead of 22C). Of course, you'll have to qualify for the Chapter 7.

        I can't emphasize enough that following local rules is the most important thing. Ask the intake or case manager in the Clerk's Office... especially if you're doing this yourself. If you are represented by a lawyer in your Chapter 13, and you're trying to get rid of them, you'll have to deal with that too.
