Discharged November 2008 100 days after filing no-asset Chapter 7. We intended to let a two-year-old vehicle go back to the bank and reaffirm an inexpensive ten-year-old SUV and our home mortgage. In the end we surrendered ALL of our vehicles and reaffirmed NOTHING. We'll "ride through" our mortgage after the court ruled it an undue hardship.

Well Keebler, I have a second mtg with a credit union, a car loan and a credit card with $23k balance. I just filed CH 7 9/30/08 (there is more debt) but all of those three things are with the same credit union. I put on the petition to reafirm the car (before I knew about the cross colleratization). My 341 is on Nov 3 and the CREDIT UNION is COMING to the 341!!!
So I guess I will be able to tell you all what happens when you have a mortgage, auto loan and credit card all at the same place!Filed CH 7 9/30/2008

Oh no! Please do come back and update us. From what I understand, CUs do seem to be more aggressive than banks. I had a mortgage, a car, an equity loan, and a CC through our bank--we discharged the car and the CC. No cross collateralization issues, but they have raised the interest on the equity loan and have been generally nasty throughout the whole process (they're still sending us statements for the discharged CC debt..I'll be handing that over to my lawyer with glee.) They seem to have taken this all quite personally.Filed BK (Ch. 7) 6/2/08

We have 2 cars and our mortgage with a CU. We also have a credit card with zero balance - same CU. We were told at the 341, by the CU rep who showed up, that they did NOT cross-collateralize the cars with the mortgage. Unfortunately we did not ask if they cross collateralized the car loans with each other or with the credit card, but I bet they do. They never sent us the updated / corrected reaffirmation papers so we did not reaffirm anything. But we are current on everything and always have been. We'll see how it goes...
If the CU should decide to take our cars, just because we never signed a reaff, when we have always been current and never late - then I think we will stop paying the mtg payments as well, live rent free for a while, and let them take the home too.
