    Owe check place? & utility question

    We have a check place loan out and we are current on it. (I know really bad but we did it thinking it would help us get by till my husband could get overtime which didn't happen.) Anyway, the question is is this listed as a debt?-- I worry about not paying it since I don't want anything to happen to our checking account.

    We are also a little behind on our electric--- for example we owe $50 from Aug bill and now Sept bill is $200 so we owe $250 due in a week of which we will only be able to pay $175. So we are not that for behind. My worry is that included in the bk? I don't want them to now require a deposit that we cant afford and there is no way we can risk havingit shut off since we have kids.

    Move your checking account and close the current one. Yes you would list this as a debt for the check place. When you are questioned about it make sure both are listed on the paperwork and tell the trustee you moved accounts to keep the check place from taking money you didn't have.

    You should get the electric bill caught up. You are legally required to list all debts and if you list them they will require a much larger deposit than you currently owe. Don't pay the CC and pay the electric bill.

      How are you paying the check place back? Do they hold paper checks, do automatic withdrawls, or do you pay them some other way?

      I ask because how you pay will make a difference in whether or not you need to close that checking account.

      I agree with JR, you need to pay that electric bill (and keep all utilites current) and stop paying all unsecured debt.

        They have/hold paper checks but we do go in every two weeks and pay in cash the payment and then they give those checks back and then we have to write a new set of post dated checks.

          If you have your heart set on keeping your current checking account----

          I would stop payment on those checks and stop paying them period. You can include them in the BK.

          This would not affect your relationship with the bank that has your checking account because you are not "bouncing" any checks or becoming overdrawn.

          If you wind up in chexsystems you can have that removed after you are discharged.

          The check cashing place may try and sue you for those unpaid checks, but so might any of your other unsecured creditors--it's no different and a total crap shoot.
