We made very small cc purchases within the last 60 days (July 08) on a couple of cc's only $5-40 for gas, food. We really want to file soon so even though these are small purchases should we still wait?

Generally small charges like that are not a problem. Mostly it is big purchases that they are looking for. I would stop using the cards though.
Many lawyers like to wait 90 days from last use, but some are willing to file so long as the charges are small. Take a copy of the statements with you so he can look over them and see if he thinks they'll be a problem.May 31st, 2007: Petition Filed by my lawyer

September 4th, 2007: Discharged and Closed.

The amount wasn't anything to worry about but it is always better to not use them at all.
