    Question Am I being to impatient?

    In March of this year I paid $1500.00 to retain an attorney to file. He told me we would be filing by the end of the month. It has now been 6 months and no action. My creditors have stopped calling but I feel I am getting the run around. He (my attorney) takes days or week to respond to my request as to when we are filing, and when he does he just gives excuses and teels me to be patient. Is there some kind of deadline as to when filing should occur from the time of retention?

    I just want to get this done.

    Am I understanding you correctly? You paid the lawyer in full in March and he was supposed to file by the end of that month?

    If so, you have a problem and your lawyer is negligent. Get yourself to another attorney and then sue this one for your money back and report him to the bar.

      Doug - when you state he would be "filing by the end of the month," do you mean the end of March (when you retained him) or a month within six months of that time? Without further information as to your situation (there could be delays due to complications in your situation) the only thing you can do is walk into your attorney's office physically and ask specifically what is going on as to your case. If a phone call and email won't work, that should. Keep us posted....

          I am filing Chapter 7, Mich, Filled out inventory, I qualify for Chap 7. I haven't even gotten the info I was promised over a month ago on credit classes I have to attend. He told me it's always changing, and be patient

          My main question again: Is there some kind of time limit?

              Holy Moly!

              I'm in Michigan and I'm also a Ch. 7 case. I made solid payments to my creditors for the 6 months before I even KNEW I was going to file and finally bellied up. I saw my lawyer end of June, fully paid in July, and I just filed Monday.

              Like Flamingo, I'm wondering if your Lawyer is wanting to get you outside the 6 month window to avoid objections.

                File a complaint with the State Bar and see how fast your attorney responds.

                  I first met with my attorney May 27th...paid the $400 retaining fee June 13th and filed June 13th. I would be impatient if I were you!

                    Yes and no, online you can get a complaint form for your state or area, fill it out, email or fax to him or her that you are feeling a bit of less than paid service that should have already been rendered and that if things do not change, you are filing this form.                       Doug, the only thing you can do, as I stated prevoiusly, is on Monday, show up at his office and find out what is going on if you cannot get answers that you understand. Ask for an update on your case and what is causing the delay. It appears to me from your posting that your attorney or others from his office have been in touch with you with some information but no one is keeping you informed as to further steps. If you are dissatisfied with the way your matter is being handled and if your visit to his office doesn't produce some information for you, give your State Bar Association a call and complain. They will tell you what to do.

                      While we know you are concerned about your matter, it is you who is going to have to do the door knocking and bell ringing to get the answers from your attorney. Showing up in the office will produce some action, believe me.
