How do I file and what do I file in NC. I used to farm, but have been forced out of it. I own my land and equipment. Haven't paid this years taxes though. Filed for an extension. Thank you.

Hello.
Well you'll need to gather some information first.
Last 6 months income
Last 3 years income tax returns (if you haven't filed for this year yet you need to)
Last 6 months of bills
Copies of mortgages/vehicle loans/etc
Estimates on value of home/farm
KBB or NADA values for vehicles (in Western NC they prefer NADA)
Estimates of other property
Next you need to see a lawyer most likely. You don't have to have all of the above to see a lawyer but the more info they have the better they can help you. They can best determine if you qualify for 7,12 or 13. Chapter 7 is a liquidation, Chapter 12 is for family farms, and Chapter 13 is a reorganization of debt. I would schedule 3-4 appointments with lawyers in your district.May 31st, 2007: Petition Filed by my lawyer

I am in the Western District, so for lawyers you probably will need to search the yellow pages in your area. That should give you a few places to call tomorrow to see when an appointment could be made to speak to the lawyer (or another day if you want to wait more).May 31st, 2007: Petition Filed by my lawyer
