Husband's bank statements if he is not filing...

My husband and I just got married a couple of months ago. Right now we both have our own checking accounts. I have met with a lawyer and should be filing for chapter 7 in a couple of months BY MYSELF. We don't live in a community property state. I know I have to get my husband's pay stubs for the last six months. I e-mailed the paralegal and she said that I wouldn't need to provide them or the trustee his bank statements if I'm not on the account...which I'm not. Does that sound right to you?

    Yes, it does.
Nolo Press book on filing Chapter 7, there are others too. (I have no affiliation with Nolo Press; just a happy customer.) Best wishes to you!

Never ever doubt the Paralegal...I am always..... I mean, we are always correct unless we accidentally say something that may or may not be wrong, which is very rare, and I mean like Haley's Comet rare and yes, since he is a non-filing spouse, they do have to factor his contribution to the household less any of his personal bills.

      Good Luck

Several of us have already caught you in two errors so please do state paralegals are always correct and if in error by accident, it's as rare as Haley's Comet... Paralegals are not attorneys and cannot give legal advice (I am also one but not involved in the BK field, but have many friends that are) and lots of us in this forum know when Paralegals from Paralegal filing services come in various free forums looking for business by posting what they do, no mistakes and what districts they contract in.

Many folks have complained on here about utilizing paralegal services for filing BK and getting in all sorts of issues and then having to obtain an attorney.

While your postings are very good, don't say you are always correct...

Lighten up Francis, I am sure everyone can tell it was said in jest, and I don't work as a " BK document filing service", I actually work for a very large BK firm, and I do consulting work for law firms around the country. I audit the mistakes that other attorneys file and figure out how to fix it. With all that said, sure I make mistakes, but back to that Haley's Comet stat........

The reason I ask is you would think they would want to see his bank statements to make sure we aren't "hiding money" or anything, kwim? They went to know every other detail....

            Thanks for your feedback!
