To answer your question, unless both his parents pass away at the same time, the house would pass to the surviving spouse. In the event they do pass away at the same time, the house would pass to your husband as he is the only surviving child. However, if they signed a will prior to passing that passed their estate to a charity or their favorite dog/cat as some folks do, your husband has nothing to worry about as to anything occuring during a BK filing (believe me, some people are shocked when relatives pass and find out where things go). What your hubby needs to do is find out how they have their wills worded. If all if left to him after the surviving spouse passes, and you are in the midst of filing BK, that is where your problem could occur. The risk of that occuring is probably very low, but there still is risk. It's up to you when and if you want to file. Best of luck to you both._________________________________________
