    Missing tax return

    I know I can't do anything about it now but.... we do not have a copy of our 2004 tax return. We have all three more current ones. What will most likely happen? We have our 341 in the morning at 9 am and I can't believe I didn't get my tax returns together until now! Any ideas on what will happen?

    Order a transcript from the IRS and forward it to the trustee when you receive it. That's all you can do if the trustee wants the 04 return.

      I didn't have all of mine either, but he didn't even ask for them! I had already told my attorney I had ordered the transcripts.

        So he won't neccesarily ask for everything the letter said to have? If I am missing a pay stub that might be okay too, then. I am swimming in a mess of papers right now! thanks for the replies!

          Well, people make mistakes. As long as you're forth coming and a bit apologetic and explain the steps you've taken to get any missing documents and you'll forward them immediately there should be no lasting issues.

            I haven't filed yet, but our attorney said we had to have copies of this year and last. And be able to prove they were filed for the past 4 yrs.

              I lucked out in this area...he only asked for 3 years worth. Also, our tax returns were able to take the place of our missing social security cards. He did take all of our money (including accrued wages) at time of filing.

                He took all of your wage? Do you mean they took your weekly pay check or just money you had in a savings account. Second question what happens to 401k we have about 13k and 1500 in a saving account will they take it or both. I will be filling next month because we purchase a computer in March and must wait the 90 days..

                  Your 401 is safe; check your state's exemptions for cash. Are you filing 13 or 7?

                    diesillady, he took 25% of our wages and every penny in our checking and savings account. Definitely check your state exemptions for your 401 as well as cash- we do not have any for cash!

                      Trying to do a cp. 7 we are close to 10k on the means test but it may work for we have about 60k to offset at 25% ratio so we may pass the second part of the test..I quess the 1500 is going toward our property tax we will owe come December. I'm just going to pay it early for we can not save enough by December if they take it. Plus we pay our home insurances which is due at the same timeof the year..

                        Where do you find the exemption amounts you are allowed.

                          just google your state and bankrrupty exemption

                          For example in south dakota I googled as above and got tons.

                          The first on the list was http://www.bankruptcyaction.com/sdexemptions.htm, but this one had more comprehensive listing http://www.bankruptcyaction.com/sdexemptions.htm

                            Be sure to check the date though....I found that some listed exemptions were from years ago and they were inaccurate. The new NOLO book has current exemptions for most states.
