Last payment to Chase was 4/07, with balance at that time $10,000; summons arrived 10/30/07 and their paperwork was dated 6/07. I had a 30 day response time, with court date (case management conference) of 3/24/08. I couldn't afford filing fees and fee waiver was denied in January, effectively vacating my response. I showed up on 3/24, asked for a continuance (I knew I'd be filing soon)and got 30 days. At that hearing I showed my BK petition; another continuance granted, then I got a notice that Chase asked to have their action dismissed.
So, from summons to bk filing was 5 months....we were vulnerable to a default judgment the whole time after the court denied the fee waiver and I didn't re-submit a response, but I'm happy I didn't know that!
There's really no rhyme or reason as to who sues and who doesn't and how long it takes....just don't let a summons go unanswered, that's a for-sure automatic default judgment.
