    Stimulas Purchase Problem or not???

    I have a question...
    We are filing this week, dropping off our papers to the lawyer. We havn't got our stimulas check yet and with the price of gas, my husband wants to spend 560.00 of the $ to get a cheap motorcycle for transportation to/from work. I view this as a questionable move with filing for BK. Please give me your input on this issue.
    Is this going to be a problem with filing? I think so, but I want your input here on this issue also.

    I would definitely talk to your attorney about this. To me it seems like it could be a problem. I do think waiting to file until you have spent your stimulus on necessities is good, but buying a motorcycle might not be so great.

    I totally agree finding a way to save on gas is a necessity but not sure a trustee would think a motorcycle is a necessity.

      If you havent gotten your stimulus yet and you file before it arrives it is technically property of the estate. Which in turn belongs to the trustee until closing. No one is sure yet if they are taking them. My guess though is in most non asset chapter 7 they will.
      Do you know when its coming? If so I would advise holding off until you get it. Skip the motorcycle.... buy gas for your car. The motorcycle could be questioned but gas wont be.

        Thank you for your answers, We needed this to make a talk about a final decision on all of this. I have only got a few calls so far from creditors on the delinquent accounts. Getting used to them. Just have to deal with them. We do not want to have a problem with filing, so I think we will deposit our taxed and stimulas and stock our freezer with meat, maybe get the clothes I will need for my son for the next year, and other necessities for living in the next couple months. In the mean time save for filing and wait to bring the paperwork until we have spent our taxes on those necessities we need. By the way, we are going to use the taxes to file which will eat up about 1500.00 to 1600.00 of our return anyways, not leaving us with much left over.
        Thanks again. I hope my hubby doesn't look at this as my saying no to a motercycle and understands it is a business decision as well as filing for BK is.

          Update... I am rethinking letting my hubby get this as he has his heart set on saving money on gas this summer. I did talk to our attourney and they said with what we have in current assets, should not be a problem. So have to do some more thinking about it.
