HELP!Unauthorized "legal order fee" taken from bank acct, another 12k pending...

    HELP!Unauthorized "legal order fee" taken from bank acct, another 12k pending...

    woke up, went into my Bank of AMerica account(which is not linked to any credit card, or private loans i owe)

    and bam -100 for Legal Order Fee(LTS)

    and another 12k pending.....

    my bank i had only ONE DOLLAR and 14 cents in it!

    what's going on? fraud?

    Most likely you have a judgment against you and the collection agency put a lien on your account.

          Here's what happened to me. I don't know if it's the same situation, but it seems similar. I had a business account and owed taxes. That account had about $30 in it and I never used it. Before I knew it, the bank sent me a notice that said that my account had a tax lien on it for $6500 and they charged my acct. a $50 admin. fee.

          Like you, I completely freaked out. What I did on my lunch break is, I went to the bank with the notice to find out what that meant. I knew I didn't need the account, but my concern was the bank charging me fees until I paid the lien. The girl at the bank was totally nice about it and told me it really doesn't mean much practically speaking because they don't lift the lien until you pay what's owed and they don't charge any fees. Well that was almost a year ago and I'm completely content to let that account stay open til the cows come home. I don't have the money to lift the lien and will let it sit until the taxes are eventually settled.

          That's my story, but I'm not sure if yours is similar, but if it is, I wouldn't worry, but I would call or go to the bank to be clear.

            but the amount can be discharged? correct?

              I'm not sure. I listed that account in my bk, but in my case I don't think this particular debt can be discharged because the lien is for taxes. My taxes can't be discharged either way so the lien will survive. I would assume that if the underlying debt can be discharged, then maybe you could discharge it in your bk, but I don't know for sure. I would find out for sure from an atty. because some of this stuff is so tricky. Hope it helps.

                When a levy is placed on your account it is for double the amount you owe whoever put it on there. So that is why your account says -12 k.

                If the levy was placed by a non secured creditor, such as a credit card account, then yes, that can be discharged in bankruptcy. If it is for unpaid taxes, in most cases no.
