    How long Can I wait

    Hello to everyone on the boards I would like to know how long I can go without paying my CC bills before they will try to sue me or put me into collections. I am planning to file BK but want to wait as long as possible because I have been using CC lately for monthly expenses. I am now not using CC at all anymore. I have been totally current on all CC payments until now Oct. 1. I have now stopped paying all CC payments. I want to know how long I can wait to file without having to worry about the CC companies suing me. IF they do sue will I get warning beforehand and be able to file BK then before they can sue me? Most of my debt is with CitiBank and Bank of America. I would really like to wait until the end of Dec to file, that would be three months of not paying- what does everyone think???

    Hi,

    If you can wait six months to file, that would be ideal. However, if it is going to be impossible for you to wait six, months. Than wait three months, and do not use any of your credit cards. If you do have to use them, be sure the charges are within the likes of: food, gas, etc. an NO luxury and discrentionary items.

    Once you stop making payments, they will begin collection activity once your payments are 30 days past due. Chances are very, very minute that they will sue you, especially if you wait six months to file for BK. If they did take action to "sue" you it will be for garnishment and you will served with thier intent. So, don't use the credit cards and wait six months.
