Do I get to keep a checking account under either chapter 7 or 13? It is not overdrawn and I use it as my primary banking source. Also, in chapter 13, how do they determine what you pay back? I go next week to start the process and I am nervous as hell!!! I don't want to keep asking my poor lawyer all these trivial questions so I figure I would bother all you kind people for a while

Your checking account shouldn't be affected unless you have ties to credit cards with the same bank that you have included on your list of debts. They determine your payback depending on your income vs expenses (standard living expenses, etc). Ask a ton of questions in here the peop's on this forum are so wonderful ! And they don't make you ever feel bad about your situation (that what I love about his forum).

You can keep your checking/savings account.
I, personally, do not recommend switching accounts unless you have cc's tied up with your accounts, it just adds more confusion & with the way banks are right now, god forbid you close your account & can't open a new one...I don't recommend it.Filed Oct 2005discharged February 2007,Shapeless in the fire's glow, tell me if you think you know,

Up until recently I had paid all of my accounts online through the credit card site's online payment which means that they all have my bank account information. Is there any reason I should be concerned about this? I know that to take unauthorized money out of my account would be illegal but there are certainly some unscrupulous collectors out there.
I do not have any other accounts through my bank besides the checking.ichb

I had done the same thing (paid all of my accts online), and just out of paranoia - while I still had access to my online creditors, I deleted any connection to my bank account information from their online system. One thing you need to do, if its not too late. Download all the statements you possibly can from the online creditors, once you file you will be denied access! And a few members in here have had Trustees asking for statements.
I also opened up a new Bank account, not necessarily closing the ones that already existed. Just so I wouldn't have any trouble getting a new account after filing.
