in late december, conta ted my attorney re existing chapter 13 of which 2 years of 3 years paid, i am well belownew jersey medium living on sma;ll pension and social security, discussed with attorney about increasing medical costs due to my health etc was paying $560 3 years, told by him to stop paying he would convert to 7, i am a no asset case but in checking pacer noticed after asset said yes, other than advice to stop paying 13, cant not seem to get him to return calls or e mails, question is shouldt i have heard something or get some time of paper work regarding conversion since over 3 months now

I don't want to seem harsh, but you really have to take control of this situation, before you are dismissed and it's too late for conversion. Alternatively, you can look into a hardship discharge from your 13. You shouldn't be forced into filing a whole new petition because of your attorney's, shall we say, inertia.Last edited by diviaruba; 04-02-2008, 05:43 PM.

Yeah, keep on em.' When I originally filed Ch13 I was no asset. When I converted to CH7, and awaited the day I was soppose to be discharged, the Trustee sent a notice that my case could have assets. I just kept on my attorney and finally got discharged, NO ASSETS!
