    ch 7 and using credit card

    Have a question and hope someone can help. Plan to file ch 7. Purchased a computer on credit in February. Would like to add that account to the BK, so I understand we need to wait 60 or 90 days? In the mean time have 1 credit card with some credit available and wondering if we can use it to make some auto repairs. How much is safe to charge without too many questions or would it no be a luxury charge.

    The total of all charges made within 90 days of filing BK should be under $750 to be on the safe side.

    The computer is probably secured debt (if you used store or online financing), so it really does not matter how long you wait (but you should wait 3 months and at least make the minimum payments on that account during that time).

    Keep in mind, if any of these transactions go awry, the worst case scenario is that you still have to pay "these particular" debts after your BK.

      We have to pay dell back as a secured debt for our computer which was purchased 6 mos before filing. This was for a BK 13 though.

        Weird, I am kind of in the same situation. I had a family vacation planned for a long time that I didn't want to miss that cost about 600 dollars that was last month. I payed with my capital one cc so I guess that means it is not a "secured debt"? I am planning on waiting about 6 more months before I file. Can I include this debt on my chapter 7 or will I have to pay it?

        I know it wasn't the smartest idea, but the trip was important and I can afford payments on a 600 debt.

          You won't get any objections over $600, it is not worth anyones time to pursue.

            I bought a Dell computer 18 months ago; attny said, at worst, they might ask for a one-time payment of it's value...or may be nothing will happen. At that point we were planning a 7, but now it's a 13 so don't know what that changes. And I think the value wouldn't be more than $400

                I almost feel like putting what we owe on taxes on my cc, it's only $163 but I probably won't. Attorney said to quit using them - I have not filed yet.

                Also, I had gotten a stove $380 or so from Home Depot - I was planning on keeping the debt and paying it with my tax rebate. It will get discharged unless I reaffirm it but I keep reading it's not recommended to reaffirm any cc debt. I just got the stove Feb 22.

                  We have a stove through Sears that's been zero payments until May; attny said same thing, don't reaffirm, just keep it and pay on it when it comes due. We have 2 other Sears acctns, that are much smaller,so it'll be intersting to see what happens when we actually file.
